What is the Parliament shut down about?


When I started blogging, I made a vow not to blog about ‘current’ affairs - in that I will never ever blog about things happening right now.  My blog would be an editorial - standing back, away and making its point from a distance - not too far away to be relegated to also-said-after, but keeping a distance, a focus different from current thinking.  Of late, I find that I am blogging almost live about TV programmes, on current affairs.  This, I promise, would be the last of such sort, except under special circumstances.

The nation has been overcome, at least in parts, about the parliament shutdown for - last 2 weeks or so & continuing.  The majority feeling has been that the ruling party is not willing to give in to the opposition on the Joint Parliamentary Probe or Committee, the JPC, and this feeling generally has been of both of the ruling coalition and the opposition.

But as usual, the mad.madrasi take is different - is it becoming too often written?  But that is the way the cookie crumbles.

My take is that it is finally a very welcome fight between the separation of the Executive and the Legislature.  If you pause a moment and try to think about it, there has been an alleged scam as reported by the CAG.

The ruling party, the Executive is promising a top-priority investigation by the nation’s premier investigation agencies and which has already been put into force.

The opposition is clamouring for a JPC, which is essentially the Legislature attempting to take over which is essentially an Executive function - enforce law and order, investigate corruption.  If ever the Legislature wants a part, it can only be *after* the investigation or if leery of Executive’s intention, to ask for a core group of legislature to be kept informed about investigation - which they already have by way of Public Accounts Committee.  I really can’t see what the problem is all about.

I am really glad that this fight is taking place and that the Executive is putting its foot down.

Which brings me to the current TV debate on the alleged attempted influence by a former Cabinet Minister on a Judge of the Madras High Court.  Today’s debate left be in splits, both in Times Now and in NDTV 24x7.  Of all the participants, only one came through with flying colours, Manish of the ruling party and only one who fell flat, in fact changed the tune between two debates, Chandan Mitra of the opposition.

The issue which was to be debated was whether the PM (in effect, the Executive) should have taken note and acted on the alleged attempt to influence the Judiciary.  All of the opposition or so leaning participants seem to indicate that since it was said that a Minister was involved, the PM should have acted.  Now, I never remember the Judge saying that it was a Union Cabinet Minister - all he seem to have said (as per my memory) was that it was a Minister - and speculations were ripe at that time about the identity of the Minister.

Justice Sachar in the NDTV debate made a valid point - if suppose it was an industrialist what should have or would have been the Judicial action and why it was not followed?  That is for the Judiciary to decide & I’ve no wish to run afoul of the Judiciary.

Dr. Swamy made the only other valid point that the PM or even the Parliament could (he implied the PM should have) have take sou motu notice and acted on it.  But of course his thrust was against the PM, but my thrust is against the Legislature - the Parliament.

Why is the Parliament, the Legislature of the India, essentially the opposition which is so clamouring to take up the JPC probe on the scam today, not so much bothered about taking the issue of an alleged threat to the Judiciary, an year back?  Just because it was not so ‘attention grabbing’ as the alleged scam is today?

My God, law makers, you are always willing to, wanting to take on the function of the Executive, but when it comes to defending the Executive or the Judiciary, you fall flat - our founding fathers, and especially Dr. Ambedkar must be worried.

My Mischievous half murmurs, ‘Maddie, you’ve gone and done it again.  Till now, you’ve been only taking on the Executive, now you’ve gone up against the Legislature too.’

But then, I’ve kept the Judiciary on my side!

Anyway, should I tell Julian Assange, to reserve the next cell for me?
